Licenza d’uso di Endless Map

Accordo di licenza con l’utente finale

Questo contratto di licenza con l’utente finale è un accordo legale tra l’utente (una persona fisica o giuridica) e l’autore di questo Software (3D Endless SRL), per il prodotto software sopra indicato, che include software per computer e può includere supporti associati, materiali stampati, e “online” o elettronica (“PRODOTTO SOFTWARE”).

Installando, copiando o altrimenti utilizzando il PRODOTTO SOFTWARE, l’utente accetta di essere delimitato dalle condizioni del presente Contratto.

Se non si accettano i termini del presente Contratto, non installare o utilizzare il PRODOTTO SOFTWARE.

SOFTWARE LICENZA DEL PRODOTTO

a) Endless Map Community viene distribuito come software libero per uso personale senza scopo di lucro o finalità educativa. Esso può essere incluso nelle distribuzioni di CD-ROM / DVD-ROM. Non è permesso imporre un costo per la distribuzione di questo software (sia a scopo di lucro o semplicemente per recuperare i file multimediali e costi di distribuzione), sia come prodotto stand-alone o come parte di una compilation o di un’antologia. Può essere distribuito liberamente su qualsiasi sito web o tramite qualsiasi altro meccanismo di distribuzione, fintantoché nessuna sua parte sia cambiata in alcun modo.

b) Endless Map Sandard o Enterprise sono disponibili a pagamento. Essi superano le limitazioni della versione base.

1. CONCESSIONE DI LICENZA.

Il presente Contratto concede i seguenti diritti: Installazione e Utilizzo. È possibile installare ed utilizzare un numero illimitato di copie del PRODOTTO SOFTWARE.

Riproduzione e distribuzione. È possibile riprodurre e distribuire un numero illimitato di copie del PRODOTTO SOFTWARE; a condizione che ogni copia deve essere un vero e completo copia, incluse tutte le note di copyright e di marchio, e deve essere accompagnata da una copia del presente Contratto.

Copie del PRODOTTO SOFTWARE possono essere distribuite come prodotto stand-alone o in dotazione con il proprio prodotto a condizione che il PRODOTTO SOFTWARE non venga venduto o incluso in un prodotto o un pacchetto che intende beneficiare delle prestazioni attraverso l’inclusione del PRODOTTO SOFTWARE.

Il PRODOTTO SOFTWARE può essere incluso in tutti i pacchetti o prodotti gratuiti o senza scopo di lucro.

2. DESCRIZIONE DI ALTRI DIRITTI E LIMITAZIONI.

Restrizioni sulla decodificazione, de-compilazione, smontaggio e il cambiamento (aggiunta, eliminazione o modifica) delle risorse del prodotto. L’utente non può decodificare, decompilare o disassemblare il PRODOTTO SOFTWARE, ad eccezione e solo nella misura in cui tale attività sia espressamente consentita dalla legge applicabile, nonostante questa limitazione.

Separazione dei Componenti.

Il PRODOTTO SOFTWARE è concesso in licenza come un unico prodotto. I suoi componenti non possono essere separati per l’utilizzo su più di un computer.

Trasferimento del Software.

Si può trasferire definitivamente tutti i diritti concessi dal presente Contratto, a condizione che il beneficiario accetti i termini del presente Contratto.

Risoluzione.

Fatti salvi eventuali altri diritti, l’autore di questo Software può risolvere il presente Contratto in caso di mancato rispetto dei termini e delle condizioni del presente Contratto. In tal caso, è necessario distruggere tutte le copie del PRODOTTO SOFTWARE e tutte le sue parti componenti.

3. COPYRIGHT.

Tutti i titoli e i diritti d’autore relativi al PRODOTTO SOFTWARE (compresi, ma non solo, le immagini, le fotografie, clip-art, librerie, e gli esempi incorporati nel PRODOTTO SOFTWARE), i materiali di accompagnamento stampati e qualsiasi copia del PRODOTTO SOFTWARE sono di proprietà di Autore di questo software. Il PRODOTTO SOFTWARE è protetto dalle leggi sul copyright e dai trattati internazionali. Pertanto, è necessario trattare il PRODOTTO SOFTWARE come qualsiasi altro materiale protetto da copyright.

GARANZIA LIMITATA

4. NESSUNA GARANZIA.

L’autore di questo Software declina espressamente qualsiasi garanzia per il PRODOTTO SOFTWARE. Il prodotto software e la documentazione correlata vengono forniti “come sono” senza garanzie di alcun tipo, espressa o implicita, incluso, senza limitazioni, le garanzie implicite di commerciabilità, idoneità per un particolare scopo o non violazione. Installando il PRODOTTO SOFTWARE, l’utente si assume l’intero rischio derivante dal suo uso o dalle prestazioni.

5. NESSUNA RESPONSABILITÀ PER DANNI.

In nessun caso l’autore di questo Software sarà responsabile per danni speciali, consequenziali, incidentali o indiretto (inclusi, senza limitazioni, danni per perdita o mancato guadagno, interruzione dell’attività, perdita di informazioni commerciali o qualsiasi altra perdita pecuniaria) derivante dall’uso o dall’impossibilità di utilizzare il prodotto, anche se l’autore di questo software è a conoscenza della possibilità di tali danni e difetti noti.
